HKIAC kicked off the first day of Paris Arbitration Week 2021 by hosting a webinar on “Protecting your interest through interim relief from Mainland Chinese courts” for more than 400 registrants.
Sarah Grimmer, HKIAC Secretary-General, shared her observations on HKIAC’s role under the PRC-Hong Kong Interim Measures Arrangement (Arrangement) and how the Arrangement is a critical consideration for deals involving assets, conduct or evidence on the Mainland. The session was moderated by Anton Ware, Partner at Arnold & Porter. Other speakers included Dr. Ling YANG, Deputy Secretary-General and Chief Representative of the Shanghai Office at HKIAC; Chungang Dong, Partner at Jingtian & Gongcheng; Karl Hennessee, Council Member at HKIAC and Senior Vice-President of Litigation, Investigations & Regulatory Affairs at Airbus; and Nils Eliasson, Vice-Chair at HKIAC and Partner at Sherman & Sterling.
Main takeaways: (1) HKIAC has received over 50 applications under the Arrangement since it came into force on 1 October 2019; and (2) the availability of the interim measures in China is a unique advantage of Hong Kong and a reason why many companies are now choosing Hong Kong as a seat of arbitration and HKIAC as the institution.
