香港國際仲裁中心問鼎最具影響的全球仲裁調查

倫敦大學瑪麗皇后學院聯合美國偉凱律師事務所最近發布了其第六版國際仲裁調查。調查結果顯示香港國際仲裁中心（HKIAC）在全球仲裁機構中排名第三，是歐洲以外仲裁機構中的最佳選擇。

本次調查結果於10月6日在維也納舉行的國際律師協會年度會議上公佈。該結果還顯示HKIAC是在過去五年內世界上所有仲裁機構中進展最大的機構。參與調查的人員表示他們對仲裁機構的選擇主要基於以下指標：案件管理能力、中立性以及國際化程度。

香港在報告中被評選為全球第三的仲裁地，僅次於倫敦和巴黎。香港還被評為歐洲以外仲裁地的首選​​，以及在過去五年內發展速度第二快的仲裁地。

HKIAC主席鄭若驊資深大律師表示“The findings of the survey really cement the fact that Hong Kong is at the very forefront as venue for alternative dispute resolution in Asia and the preferred seat for complex disputes involving parties from across the globe”。

皇家御用大律師、德普律師事務所歐亞訴訟部主席Peter Goldsmith閣下談到“With its unparalleled geographical connectivity, modern legal infrastructure, independent judicial system, strong arbitration and industry expertise, and impressive enforcement record, Hong Kong meets or even exceeds all standards in the recently introduced CIArb London Centenary Principles”。

史密夫·斐爾律師事務所全球爭議解決部負責人Justin D'Agostino 贊成Goldsmith閣下的評論，並表示“This is a fantastic reflection of the growing reputation and strength of Hong Kong's arbitration space. Hong Kong's court system is strictly independent and has long been considered a pro-arbitration stronghold in Asia”。

調查還列出了一些需要加強制約和管理的領域，比如仲裁庭秘書的使用。 HKIAC最近頒布了一系列針對這些領域的新舉措，例如仲裁庭秘書服務以及與之配套的使用準則。這一舉措旨在規范仲裁庭秘書的使用，並提高這一實踐的透明度。另外一個需要加強管制的領域是仲裁員的能力和表現。在這一方面，HKIAC最近推出的仲裁員評估系統能使HKIAC通過用戶的反饋意見採取適當的措施以改善和提高仲裁員的素質和水平。

今年的調查結果在以往的報告基礎上著重於近年來在國際仲裁領域的改革和創新。 763人參與了網上問卷調查，105人參加了個人訪談。

HKIAC獲得全球仲裁機構前三名的榮譽正值其30週年慶典之際。該慶典將於10月26至29日在第四屆香港仲裁週舉行。就此，HKIAC鄭主席表示“With its 30 years of commitment to international arbitration developments, HKIAC is now firmly established as a global leader in dispute resolution services. The results of the survey are clear evidence of this achievement”。

在10月27日舉行的ADR in Asia大會將對本次調查結果進行更詳細的討論和分析。
