2018 HKIAC Administered Arbitration Rules Roadshow

Please join us as we continue with our roadshow around the globe to show case our new 2018 HKIAC Administered Arbitration Rules. We will be coming to New York on 11 June 2019 and London on 19 June 2019 where we will have roundtable discussions with a panel of legal experts on the new Rules through a case study. In particular, the panel will consider the Rules in relation to effective and efficient management of complex arbitrations, including provisions on joinder, consolidation, single arbitration under multiple contracts and concurrent proceedings, as well as other key features of the Rules.

The panel will also discuss the latest trends coming out of Hong Kong and Asia, including an update on China's Belt & Road Initiative and on Hong Kong's role in dispute resolution involving Chinese and foreign parties, as well as recent developments at HKIAC relevant to such disputes.Read more

2019 ASA Arbitration Practice Seminar

The Swiss Arbitration Association (ASA), in collaboration with the Hong Kong International Arbitration Centre (HKIAC) is organising the first Asia edition of the ASA Arbitration Practice Seminar from 24-26 May 2019 in Da Nang, Vietnam. This retreat style conference has been successfully held in Europe for over 20 years, bringing together experienced arbitration practitioners to contribute to the debates, and to build on their own knowledge of international arbitration.

During the course of two days, sessions will be led jointly by two discussion leaders, one with a common law background and the other with a civil law background, and participants will be invited to share experiences, questions and ideas in lively debates. Discussions can continue over luncheons, at cocktail receptions and at dinners all of which are included as part of the conference experience.

Who should attend?

The seminar is designed for those - arbitrators, counsel, in-house lawyers, experts - who wish to continue building on their international arbitration knowledge and practice and to benefit from the discussion leaders' combined experience and expertise.

HKMC Seminar: "Mediation and Mediation Skills as Good Business Approach"

Mediators work with people who are working with the issues between them.

Mediation is essentially an assisted negotiation and while direct negotiation between the parties is the most efficient way of resolving disputes if this breaks down, the next best option is to involve a neutral third party to assist, utilising a process framework which makes fruitful discussion safe and potentially productive.

How does this happen? While all mediations are unique, at the same time there are some recurrent themes around the people aspects of disputes that can emerge. Mediators use certain skills that can be applied in the business environment.

This seminar provides individuals with the opportunity to explore a more pragmatic approach to negotiation and developing a strategic approach that the negotiator will be able to apply.

Understanding Chinese State-Owned Entities - Doing Business and Resolving Disputes with Chinese State-Owned Entities

In today's global marketplace, State-owned entities (SoEs) are increasingly involved in cross-border commercial and investment activity. This is especially so with the implementation of China's outbound investment programme, the Belt & Road Initiative, in which Chinese SoEs are playing a leading role. The increased involvement of SoEs in cross-border commercial and investment activity gives rise to important issues concerning the nature of SoEs, business risk management, and dispute resolution.

The Secretary of Justice of the Hong Kong Special Administrative Region (HKSAR), Teresa Cheng GBS SC JP will deliver a keynote speech. Experts will discuss the legal issues relevant to doing business and resolving disputes with Chinese SoEs.

It is anticipated that 600+ competitors will descend upon Hong Kong for the 16th Willem C. Vis East International Commercial Arbitration Moot. This year's competition will feature the new 2018 HKIAC Administered Arbitration Rules, which recently came into force on 1 November 2018. During the week of the competition in Hong Kong, HKIAC is opening its doors to participants, including competitors and arbitrators, each day from 1 to 4 April 2019 between 2:00pm to 4:00pm for those wishing to visit the Centre. This open house will feature a presentation by members of the Secretariat and a tour of HKIAC. It will be an opportunity to meet the team at HKIAC and learn more about the work of the Centre.

HKIAC Annual Lecture

You are cordially invited to attend the inaugural HKIAC Lecture, delivered by Gabrielle Kaufmann-Kohler.

Gabrielle Kaufmann-Kohler currently serves as President of ICCA, the International Council for Commercial Arbitration. She practices international commercial and investment arbitration and has acted in over 220 international arbitrations, mainly as arbitrator. Gabrielle appears on numerous institutional arbitration panels (including ICC, ICSID, AAA, LCIA, SIAC, CIETAC) and conducts arbitrations under the rules of all major institutions. She is regularly ranked among the top ten arbitrators worldwide; a study of investment arbitration released in 2016 concluded that she was the "most influential arbitrator in the world".

A Professor Emerita at Geneva University Law School, Gabrielle is also the founder, former director and a current faculty member of the Geneva LLM in International Dispute Settlement (MIDS), a joint program of the Graduate Institute of International and Development Studies and Geneva Law School. She is also a visiting professor at National University of Singapore, Tsinghua University in Beijing, and Georgetown University and the President of the Council of the Center for International Dispute Settlement (CIDS). Gabrielle teaches courses on international commercial and investment arbitration and heads research projects in the area of arbitration.

She is Honorary President of the Swiss Arbitration Association (ASA) and was ASA President from 2001 to 2005. Gabrielle is also a founder of the FIAA (Foundation for International Arbitration Advocacy) and the President of its Advisory Board, as well as a former member of the ICC Court, LCIA Court, and AAA Board. She was and is a member of the Swiss delegation to UNCITRAL, including within Working Group II on transparency (until 2014), and presently Working Group III on the reform of investor-state arbitration, for which she has co-authored two CIDS reports.

Formerly, Gabrielle was a professor (international arbitration, 1997-2018) and assistant professor (private international law, 1993-1997) at the University of Geneva Law School; partner of Schellenberg Wittmer (1996-2007), and partner (1985-1995) and associate (1981-1985) of Baker & McKenzie, in Geneva and New York. After studies at the University of Geneva (law degree 1974) and a doctorate from the University of Basel (1979), she was admitted to the Geneva Bar (1976) and New York State Bar (1982).

AIIB Legal Seminar - A Project Finance Toolkit for the Asian Infrastructure Investment Bank

The Asian Infrastructure Investment Bank (AIIB) and the Hong Kong International Arbitration Centre (HKIAC) are pleased to present a joint seminar to explain and discuss legal and commercial aspects of AIIB's status, policies and projects.
