On 22 March 2018, HKIAC held its Arbitration Clause Negotiation Workshop in Frankfurt. The workshop was hosted by CMS Hasche Sigle’s Frankfurt office and supported by HKETO, HKTDC and TDM.
The event was moderated by Joe Liu, Managing Counsel at HKIAC, and featured a negotiation of two arbitration agreements between Jan-Michael Ahrens, Principal Counsel for Dispute Resolution at Siemens, and Jakob Ragnwaldth, Partner at Mannheimer Swartling, on one side, and Florian Cahn, General Counsel of Framatome, and Arne Fuchs, Partner at McDermott Will & Emery, on the other. Benjamin Lissner, Partner at CMS Hasche Sigle, was the commentator.
Following a hard-fought negotiation, both sides eventually agreed to include, among other things, an arbitration clause designating HKIAC as the arbitral institution and Hong Kong as the seat of arbitration in their contracts.
